As prescribed in USCG guidance at (HSAR) 48 CFR 3017.9000(a) and (b), this clause may be included in sealed bid fixed-price solicitations and contracts for vessel repair, alteration, or conversion which are to be performed within the United States, its possessions, or Puerto Rico. Unless inappropriate, this clause may be included in
negotiated solicitations and contracts to be performed outside the United States.
DISCHARGE OF LIENS (DEC 2003)
(a) The Contractor shall immediately discharge or cause to be discharged, any lien or right in rem of any kind, other than in favor of the Government, that exists or arises in connection with work done or materials furnished under this contract.
(b) If any such lien or right in rem is not immediately discharged, the Government, at the expense of the Contractor, may discharge, or cause to be discharged, the lien or right.
